Tier 1 - ILR 90 day rule

Post by sid008 » Tue Jun 05, 2012 7:02 am

Hi Folks,

I know this has been done to death but would like to get views on my particular case.

I apply for my ILR in June next year. I have not been out of the country yet for:
1- Continuous 90 day period
2- Total of 6 months

I have been working for the same company for the last 5 years and have now been sent abroad by the same company on a project. During my stay abroad I will continue to receive my salary in the UK (in Sterling) and I maintain an active bank account in the UK as well. The project is for a total of 6 months, I will travel to UK every 60-70 days or so (i.e. less than 90 days).

My question is, will this affect my ILR? I will not be staying for a continuous 90 day period outside UK but I will have stayed outside the country for over 6 months in total in the last 5 years.

My company is willing to provide letters confirming I was on a work related project and that salaries were paid in the UK. I also have supporting bank statements, P60's etc.

Any similar personal experiences you have had you might want to share?

Thanks in advance.
