Implications of extension refusal

Hello friends,
My application is more than 1 month before visa expiry because I have to go to India for urgent personal reason and will be back just 3 days before current visa expires and if i apply just at the end , I may not have sufficient time to gather the documents then.

(I have planned to give P60 and bank statements as proof of earnings which gives me enough points for my extension. However P60 has gross and PAYE, Bank statement had gross-NIC-PAYE. so there is a gap of NIC payments which I believe will be the case for anyone who uses these two documents. For other proofs of earnings- I am not entirely sure that they are foolproof for me.)

I will still apply because my documents are genuine and correct and hence it might go through. However in case my visa extension doesnt succeed this time, can I go to India and come back inspite of an extension refusal and apply in those last 3 days before current visa expiry?

PS: Currently I am doing it through PEO application

Yes.

That said, do take into consideration the fact that your in-person application may be deferred (if the caseworker deems so). In-person application doesn't necessarily mean "same day decision".

Do I get my passport back for deferred decision? If not then does it take a lot of time (because this might affect my plan to go to India)

No. It may - depending on the reason(s) of such deferment.
