URGENT, a PhD student who is being asked PhD certificate.

Dear all:

URGENT, please anyone can help this problem?
I am applying Tier 2 visa now.

I just received an email from UKBA, asking me to provide PhD certificate or A letter from University confirming that you have completed your studies. I am a PhD student (started from Sept 2008 till now) who have already submitted my thesis but has not done my viva yet but I think I am eligible for applying Tier 2 visa.

I don’t know why they asked me to provide PhD certificate or A letter, is it because that I answered YES to the question ‘Have you completed a course of study of at least one academic year during your last period of leave.’ What should I answer to this question?

What should I provide to UKBA?

well it seems fairly obvious that they have asked you to provide the certificate/letter because you said you had completed the course, you should have answered no to the question.

I would suggest you ask for a letter from your university confirming that you have submitted your thesis but have not yet done your viva, and include the start date of your course. Explain why you answered yes to the question.

Thanks a lot Greenie.

It seems that I gave the wrong answer to the question when filling the Tier 2 visa application form.

I will send them a letter from University clarifying the situation but do you think if I can be issued the visa in the case I gave the wrong answer?

As far as i remember, for PhD you do not have to have certificate to apply for Tier 2 Visa. Just go through the Tier 2 guideline one more time to find the format for Letter from your university. And then go to your research office at the University ask them to write a lettter with the format mentioned in Tier 2 guideline document. Then send that document to UKBA. You should have given that letter to UKBA when you've applied for your visa. You are lucky they have contacted you.

You can get a Tier-2 without the PhD ofcourse, so them asking could mean two things: either you said yes to that question, or because of new settlement rules that exempt PhD-level jobs from certain restrictions now put in place for Tier-2 settlement routes.

But I am not sure whether to prove a job is PhD-level, you have to prove you have the degree and employer states that it is a PhD-level job, or it is sufficient for employer to state that the job is PhD-level and the best candidate they could find is yourself, and who is just months away getting his/her PhD degree.

Without sitting the viva, the best your letter will say is that you have submitted your thesis and waiting for the viva, indirectly, saying that you haven't yet been issued with a degree yet. It's similar to a student who's written exams and awaiting results. And then the case worker decides whether to treat this as a PhD-level or not.

In any case, unless you are hitting your 5-year mark, the nature of the Tier-2 doesnt matter at this stage. It's only when you are in your 3rd year and seeking a Tier-2 extension, you need to make sure that you get one that gives you the option to settle if you wish to do so.
