Same day application @ PEO for Tier 1 (General)

Hi,
Is it true that all Public enquiry offices do not accept same day service applications for self employed applying for ILR under Tier 1 (General)?

I spoke with a lawyer and he mentioned that.

I was on Work permit (6th December 2007) as a staff; switched to Tier 1 (11th November 2009) and have been contracting as an engineer for 2 years. My plan was to apply for ILR with my family on the 8th of November this year (28 days before my 5th year) using same day premium service as my tier 1 visa will expire on the 11th of November this year.

Advise greatly needed, thanks.
