Tier 2 - Discrepency in Employment letter

Hi all,

I am currently on Tier 2 (ICT) [was previously on WP] - have been in UK continiously since May 2007. I am now applying for my ILR.

Based the sticky notes in this forum - had requested my employer for a reference letter, but he has provided me a letter which is different from that.

the format of the letter is ...

To Whomsoever it may concern.

Mr. ABC is a permanent employee of XXXXXX and he is on a long term assigment in UK since May 25th 2007.

His current designation is Software engineer and his salary is GBP XXXXX per annum.

The SOC code of the employee is 1234 - Software Engg.

The letter has been provided upon the request of the employee. should you have any query please contact us at ....

My problem is :

As per SET(0) form

1) No where in the above letter they have mentioned explicitly that "his services are still required in UK" - [instead they argue stating "long term assignment" signifies the same]

2) They have not mentioned - the salary is at/above the prescribed levels for the given SOC code as per Tier 2 sponsor guidelines
- [though my salary is well above the specified limit ]

Have anyone been is such a situation ?
Will the above format suffice to convince the casework or are they very much specific on the format of the letter ?


P:S - I am pushing hard on my employer to provide me letter as per sticky notes but no luck so far and my appointment date is fast approaching - bit concerned on these 2 points.

Please advice. thanks in advance.

1. Is an issue, IMHO.
2. Though the immigration rules clearly states what the employer must certify, this should not be an issue as the CW will be able to check the appropriate rate for the given SOC on his system and check if the salary matches up.

Hi

To the best of my knowledge the answers to your questions are.

1. His services are required in the foreseable future is a Mandatory line in the employment letter required by the UKBA as its already mentioned by Sushdmehta with out that line being clearly mentioned in the employer letter issued by your employer for your ILR application your employer letter will not be accepted by the UKBA.

2. Again for the SOC it would be a lot more help full for the case worker if you just take the prinout of your SOC code as published on the UKBA website and highlight your SOC code and salary amount and I will further suggest you that ask your employer to mention that if your salary is higher or at the level of the SOC codes.

Please do kindly share your PEO experience on the forum.

thank you for your inputs.

Spoke to my employer/HR and they seem to have understood and showed some positive signs now waiting for the letter.

Hoping for the best. Will surely share my experience.
