how long can i stay out of the uk on a work visa

hi, i know this might sounds like a strange question but im hoping someone can clear this up.

how long could i be out of the country before my tier 2 working visa laps? i have it for a further 2 years but if my employeer is ok with me taking say 8 months off and travelling is that going to be ok to re-enter and continue to work? thanks!

If you come off the payroll for more than one month you are no longer a sponsored worker. Furthermore, absence unrelated to your employment of more than 3 months in one stretch, or 6 months in total will reset your ILR residence period.

thanks for your reply. so say for arguments sake i wasn't looking at ILR, but i still had holiday pay owing. I then asked my employeer to pay me a minimal amount each week, therefore still 'on the payroll'. then how long could i be out of the country, or is there only the 2 year limit outlined in the guidlines?

Keeping you on the payroll is not sufficient. If you continue to be employed but cease working for your employer for more than one month, other than due to sick, maternity, paternity or adoption leave, then this must be reported to the ukba and your leave will be curtailed. See para 323A b) iii )

thanks very much for your answers, its much appreciated. i have one last question. if i was working for my sponsor in another country outside of the UK, say if i was needed to work elsewhere and i was still being paid by my sponsor how long could i then be out of the country for?

If you continue to be employed and paid by, and working for, your sponsor in the job stated in your CoS then your sponsor can send you on a temporary overseas assignment for any length of time within the work period stated in the CoS, however, the change of workplace has to be reported.
