Help me to bring my father in UK

Help me to bring my father in UK

I want to make an application for my father for his Permanent stay in UK. Me and my wife both are British Citizen. Both working full time have our own house and a few properties.

My parents have already been rejected twice for their permanent stay. They made their application from India and were rejected both times. First time because my sister used to be in India at that time. and second time becuase my father does not FULLY financially my dependent. He is a retired govenrment officer and gets a pension of Indian Rupees of 22,000 and has his own house. We did apply for an appeal the second time but got rejected for the same reason (not Fully financially dependent)

My mum passed away last year and now my father is totally on his own in India. I have one sister (she used to be india at the time of my parent's first application) and she is settled in UK. Will be getting her British Passport in July this year.

I do occassionally send money to my father but I can not say that he is fully financially dependant upon me.

My father does have a valid Visit visa at the moment and this is going to expire in Feb 2013. He is already over 78 years old and does not like travelling.

There is no other close relative in India who can lookafter him. He is literally on his own and lonely since my mum passed away.

Is it worth applying for his ILR while he is in UK during his next visit?
Is there any other option?

I will be highly thankful if someone can help. If any more information is needed please let me know.

the requirement is not that your father is fully financially dependent on you, but wholly or mainly financially dependent. It appears however that your father is not this either, as nothing has changed on the financial point. Unfortunately the rules require financial rather than emotional dependence. Personally I believe there is a flaw in the rules, after all a person who is financially dependent can be financially supported if they remain overseas, a person who is emotionally/physically dependent cannot, but these are the way the rules are written.

Given the fact that your father has had 2 refusals, it seems that he is fortunate to have a 5 year visit visa. Applying for ILR whilst he is in the UK as a visitor presents a risk that this visa will be curtailed if they think he does not intend to leave the UK. As is stands he is able to come here for 6 months of the year, presumably you and your sister and other relatives could also visit him for the time he is in India. An application for ILR would fail on the rules, your only chance would for it to be allowed on compassionate grounds, but making this application carries a risk that he will no longer be able to visit you, which surely would make matters worse. I would strongly suggest you seek advice from an experienced immigration solicitor before attempting to make this application.

Hi vk2003, have you managed to have your father join you in the UK permanently? i am now in the similar situation and was wondering if you can help me with your experience.

Only very few have done this - suspect these are from countries where local care is not affordable - i.e. not third world countries.
