ILR - Section 11 Query (As an HSMP+Tier 1 Applicant)

Post by apeterso925 » Thu Jun 07, 2012 7:17 pm

I'm gathering all my documents together to apply for ILR at the end of next month, I will be applying by post rather than in person.

I'll be applying on the basis of 2 years on HSMP and 3 years on Tier 1 General.

In section 11, it appears that section 11L is the correct part to fill out and the first part gets covered by showing my earnings in the last 12 months.

But I'm not really clear on what I need to provide for this part:

"For the period before you were granted leave as a Tier 1 (General) migrant, documents showing that you met the relevant requirements of the immigration rules."

I know this has been discussed here, as I've found several posts, but there hasn't really been a consistent answer.

For those of you who have had ILR approved, as an HSMP/Tier 1 applicant, what did you provide?

When it says "the period before you were granted leave as a Tier 1," I assume this means when I was under HSMP?

I rang UKBA today and wasn't really able to get a clear response :(

What would one show, to show that they "met the requirements" for HSMP?

Any help is greatly appreciated!

Section 11L is correct. You need to take your initial HSMP approval letter and to be on the safe side I took both my initial HSMP approval letter and my TIer 1 Extension letters from ukba. But the chances are they might not ask you to produce this document but be prepared in case they do.

Thanks for the response. But it looks like I also need to prove "economic activity" for the two years I was under HSMP?

I see others have submitted P60s and some haven't bothered.

Over the 5 years I've been in the UK, I've had about 15 months of unemployment, due to the relocation to the UK and redundancies in 2008 and 2009. I was fine, financially, because I had savings. But I was not "economically active" during those periods.

In my first two years, when I was on HSMP, I did not work for 8 of the 24 months. Will my unemployment periods negatively affect me in section 11 of ilr?

Also, just to clarify, I am not applying in person, I will be applying by post.

Thanks for any advice!
