EE2 extention possible?

Post by ipnovatis » Thu Jun 07, 2012 8:53 pm

Thank you for reading my post !
i appriciate your advice in advance.in a veru uncertain situation and not sure what to do
im non EEA national, married for 9 years to EEA national(Austrian)we have been living together for 4 years as married couple in another EU state.(Greece)where i was resident almost all my life but coz of Greek low and the army service i never got my Greek passport.
When moved to the UK i got dependency visa as a partner of EU national.(entry clearance, than residence card on 5 years)
When we moved to the UK my wife was studying. She never worked here in the UK and we where self sufitient but didn't have Private insurance as nobody told us about it(RC obtained through visa agency)
Because of financial situation in the country in 2009 we decided to leave the country,In Greece was not much better and we went to Bosnia where im originaly from but left when was 5,perents got retired and we where helping my brother and dad with their new bussines)
We are back to the UK in April 2012 asked home office to return on the same residence card and that was ok
My residence card will expire in July 2012 and what my options are?
Can i extend it ?Home office told me there is no need for that but if i leave the country i need visa.
My wife not working,i got part time job from previous emplloyer,we have saving of about £ 15000 .we leave in my cousins property here and we pay only 300£ a month which is nothing for London as my cousin do a bussines in my Shop in Athens. We never got any benefits in any of the states.
Ihave tried to contact few visa agencies and asked me to pay 1st even before asking any questions;-)
One told me my wife cam be self suffitient with at least 16000 on her account but refusal rate is very high. She started some online beauty course when we came back but thats not considered that she is exercising EU Treaty Rights.
can i apply for extention if possible at all if she is looking for work?
Many thanks Marko

You have presented a lot of information here.

As I understand it, you have a RC that will expire in July 2012. You did not spend five years in the UK. You left for a period. If that period was more than six months (or up to a year in some circumstances), your residency will have been broken. If it was broken that is not a huge problem, it just means that you might not be able to apply for permanent residence.

How long has your EU spouse lived in the UK? Perhaps they have acquired permanent residence already.

You can easily apply for another residence card, but to do so your spouse must in general be a worker, student or self-sufficient person.

Thank you for your post
Yes we have been much more than the time we where alowed to be away.it is just over 2 years.we came to the UK together and have left at the same time.so many different answers got from different visa agencies tham im a bit worried now.
My wife not working at the moment .she is looking for work but to be honest as she is stdying online some beauty course not keen to work til not finish next year.only if comes the days thats she can handle but at this work market situation wont happen before i need it for the application.self suffitient was told high rate of refusal .
My wife has a blue card but not permanent residency though is not expire date on it is RC
Thank you
