I am a British citizen born and bred but my husband is Turkish, he initially came to the uk on a 2 year tourist visa which we then changed to a temporary leave to remain with work permit. H has been working in the uk for 16 months and we are now due to apply for his ILR.
One problem on reading the small print I see the words No recourse to public funds,
I claim HB and CTB in my name but had to give them my husbands name too as the tenancy agreement is in both names and also CT and WTC which my husbands name is also on as he is the one working.
I am confused is this going to be a problem with his application and should I just tick the box that I claim or that we both claim
HELP ME PLEASE

what type of leave to remain does your husband have exactly? What application form did he submit?

See benefits affecting ilr please read before posting in this section

it is not usually possible to switch from leave as a visitor to leave as a spouse.

He came on a 2 year tourist visa during that time we apllied for and got permission to marry, at the end of the 2 year visa we applied for temporary leave to remain at which time he got 2 year temporary leave to remain with work permit as a spouse.

I have read the section you suggested on benefits and ilr but still struggling to figure out if I should tick the box saying I am claiming or my husband is claiming as I have to provide bank statements at which time they will see I recieve cb and hb and ctc plus wtc

there is no two year tourist visa. (there is a two year multiple entry visit visa but holders can only stay for 6 months at at time and it is not possible to switch from leave as a visitor to leave as a spouse. Are you sure about his initial visa? Also there is no such thing as 'temporary leave to remain with work permit' there is two years limited leave to remain as the spouse of a settled person, which includes permission to work, but it is not called a work permit

I presume that is the one then he has his visa card with him at work at the moment...his previous visa was got through filling in the FLR M form...
His initial visa was a 6 month tourist visa when he came for the birth of our first child in 2007 he then was granted a 2 year multiple entry visa in 2008. Then in july 2010 got a 2 yr limited or temporary with work permit as a spouse. this runs out in july 2012 which is when we are applying for ILR.

Would you be able to help with my initial question of whether i should tick the box saying i have recourse for public funds and if my husband has also

Hey, I was just granted ILR, my husband is a British citizen, we have been going through some rough times with money due to my carpal tunnel syndrome (CTS) and he wanted to know since I now have ILR he wanted to know what benefits I myself can claim. I have worked in the UK over about 98% of my time living here. I just need some advice and some pointers on where to go about all this.
