Wife has ILR - Questions on moving to UK & Financial Req

Post by fredp » Fri Jun 08, 2012 10:45 pm

Good evening. First time poster here. I have a few questions I was hoping someone could answer.

First off, my wife and I are both US citizens. She lived in the UK and was married to a UK citizen and obtained ILR during this time. They then divorced and she moved back the US. She still has ILR as she's been back to the UK several times since.

We recently were married in the US and currently live in the US. However, we are thinking of moving to the UK. Would her ILR status improve my visa application options? i.e., make it easier for me to obtain a work visa? Or is her ILR status irrelevant to me? What are my options for applying for a visa?

Many thanks.

The most appropriate route for you would appear to be to apply for leave to enter the UK as the spouse of a settled person (based on your wife's ILR).

The following UKBA information will be useful to determine whether you satisfy all the requirements...

When was your wife granted ILR?
Since when has she been living in the US?
On any of these trips, has her passport ever been endorsed with "leave to enter" stamp?
Life isn't fair, but you can be!

Thanks for the link. She was granted ILR in 2009, been living in the US since 2009 and has not had her passport endorsed with "leave to enter."

Now i am confused about the new income requirement, "You must have an income of at least £18,600." Both of us have separate incomes above that in US Dollars. Is that enough to meet the requirement? Or does my wife need to earn that amount in the UK for six months before I can apply to for the spouse visa? Please advise. Thanks!
