Married and Disabled.

Post by heedcase » Sun Jun 10, 2012 1:42 am

I am married to an american citizen now for 5 years and she is living with me in the UK but she is not a legal citizen of the United Kindom. Thing is over the past couple of years I have had problems with my knees and now I am disabled with knee arthritis. She looks after me day and day out. I am on ESA and DLA as well as Housing Benefit.

I want my wife to become my care on a permenant basis and want her to get a visa to become a legal citizen. I don't want her to leave the UK as I would be lost without her and need her help in more ways than you could believe.

How do I go about getting a her a Visa as I am new to this and need a lot of help. Sorry to be a pest but I need help to get my wife legal in this country as it is not fair on her and not fair on me, I looked after her all this time with no help but everything is changed now and I feel so bad.

Any help would be greatly appreciated !!!

How long have you been married and how long has she been living in the UK? What type of visa did she use to enter the UK?

How can you say this is the 'exact same situation' without the op answering the questions put to him. This link is four years old.The information contained in it is now out of date.

Hello there, thanks for the quick replies.

I have been married seven years to my loving wife and she has been staying in the UK with me for 4 years. She came over with a visitors visa and was only able to stay for 6 months.

Things changed and she didnt want to go home and I didn't have the money to file till now and with the change in circumstances with me becoming disabled with my knees, it is paramount she stays with me !

Find a compent immigration lawyer and apply for discretionary leave. I can't see any other options within the immigration rules.

Isn't that just for asylum seekers? Sorry I am just trying to understand the procedures.
