Question on BRP

Post by dschmidt » Sun Jun 10, 2012 3:56 pm

I'm a teacher who is taking a group to Belgium on June 11th and I have a question. In the event that my Visa extention is approved I get my passports back in time but NOT my BRP card can I still leave and enter the UK?

I am asking because on the timelines thread there is often a few days difference between receiving the passports and the BRP card.

Thanks,

Daniel Schmidt

You mean tomorrow? You can certainly leave but there will be no evidence of your permission to live in the UK in your passport so getting back in may be a problem. You might be able to argue that you have been granted leave and the Border Force might be inclined to check their database, but there is no guarantee of this. Meanwhile, while you are delayed by this, all the kids will be in the arrivals hall waiting for you to direct them.

The other consideration is that of carrier's liability. Airlines, trains and ferrys are very wary of allowing passengers to board when they no evidence of their permission to enter or remain in the UK.

What is your nationality?

I meant July 11th. Sorry. I am from the USA but living in the UK and awaiting a Tier 2 visa renewal.

The fact that you are from the USA will help you arrive in the UK (the airline won't deny boarding) but how you then enter is a matter for further debate. I think if you arrive in the UK they should be able to check your status in the database and admit you. You don't want to enter as a visitor (nor will they allow this if you are working). Good luck.

Have letter from your employer explaining your status.
