Retention Of Right After Divorcing Bulgarian

Post by PoorMe » Mon Jun 11, 2012 10:33 am

First of all let me thank you all for all the contributions that you make here - you have really helped a lot of people. I wish to put my case to you so that you can advise me on how best to handle it.
I am a non-eea family member married to a Bulgarian. We got married in Bulgaria in 2009 July and came to the UK in July 2010. she applied for yellow card and got it in January 2011 the same as my residence permit. She is a student but soon starting holiday and will resume in October. At the moment she works part-time 20hrs a week andduring the holiday she will work fulltime. I have been working fulltime since Jan 2011.
Now I have caught her cheating on me and I cant bear it any more. You know how it feels when the person you love decides to cheat on you. I want to divorce her soonest possible.
My question is how can Retain my right of Residence? before divorce petition we shall have had 3yrs and 1 month of marriage. What will I use to show that she is an eea citizen exercising her rights bearing in mind during divorce she will be on holiday. Can I use the fact that she is working? If I use the fact that she is a student will need Insurance? she has been working 20 hrs a week for 10 months continuous.

You need to show the marriage certificate, decree absolute (3 years of marriage), evidence she was working till date of decree absolute, evidence you are working following divorce. you don't need insurance if she was working even part time
