ILR App. submitted but employer is refusing to let me work

Post by mansa » Tue Jun 12, 2012 3:18 pm

:( I submitted my ILR Application and that of my family since on April 20th 2012 in line with the Home Office advice of at least a month before it expires.I have not recieve any acknowledgement form them until now.
Both me and my wife works for a recruitment agency which are now been taken over by another firm. That firm however, refused to let us work without physically seeing our passports.Despite showing them a reminder letter from the HO,that stated that we keep our right to both work and benefit whilst our application is being processed.
Now am worried that come Friday,me and my family may be keep out of our rented house,no work or money even to feed the kids.

What do i do now, please someone help me.

Hi Mansa,

Ask your employer to call the UK BA settlement phone line (I think the number is 0870 606 7766). You are legally allowed to be working in the country and there is a help line especially for employers to call and verify this. Just ensure your employer has your details/ case number etc when they call.

I've actually changed jobs during my wait, and the letter of acknowledgement was sufficient for a brand new employer!

Hope that helps!

Hi AussieSetO

Hope you are well? You mentioned about changing jobs while they are processing your ILR. Will it complicates the results of your application? I have been waiting more than 5 months after my PEO application.

Best regards,

ZyRon33,

My application is through Ancestry (Set O), so perhaps it is less complicated for me? I spoke with MANY caseworkers on the phone before I left my old job to make sure it would be fine- and the advice seemed to be that so long as I was employable (and didn't appear to be about to suddenly claim benefits), there would be no issue. I sent my offer letter from my new employer to the UK BA last month as an additional document (initial application sent on 12th March), just in case my case-worker calls my old employer to verify that I'm working.

I haven't received acknowledgement of this but i'm not really expecting to. I've done my biometrics, but am still waiting for ILR.

Hope this helps!

Thank you for that advice. The employer phone that number 03001234699 and where asked to fill in the Employers online enquiries form which they said they did but havent heard from them yet.
Spoke to someone one on 08706067766 and the guy said my employer is just been awkward but i still keep my right to work and benefit.
How long does it take for one to get an acknowledgement letter?.I sent out my application since on April 20th.

The employers checking service has a service standard of 5 working days. Are you sure that your employer is not making up stories.

Has the payment been taken from your account / card?

Actually, mine is at no cost to me as a refugee. They said. But the acknowledgement letter seemed to be taking too much time.As for my Employers,i cannot verify if they have actually filled in the form.Am just in a very dire situation.

Thanks everyone.

Which form did you use to apply for settlement?

Your employer is being unreasonable. They need to call the employer checking service - who will tell them what they have told you - that you are allowed to work. Perhaps you can also call the checking service again yourself and ask them if there is anyway that they can contact hte relevent team to get acknowledgement letter sent out asap. Do you have a union where you work? If so you should speak to them. Whereabouts in the country do you live?
