9 months payslips and 28 day rule

9 months payslips and 28 day rule

Good morning everyone.
I had HSMP for 2 years followed by tire 1 for 3 years. my current tire 1 validity is up to 03/aug/2012, incuding 03/aug/2012.

I have 3 questions
1) If i post my application form on 07/july/2012(this will reach home office on 09/aug/2012) i believe I will not come under new rules from 09/aug/2012. My application will considered as submitted on 07/july/2012. am i right?
2) instead of placing 5 years financial activities, i will be placing only 9 months payslips, my salary limit can be reached in 9 months according to the application form.
3) If i apply on 06/july/2012, is that mean i am applying on 29th day and my application may be rejected.

Also i believe following documents are sufficient and no other documents are necessary please confirm,
a) 9 months payslips, 9 months bank statements
b) cohabitation documents, council tax bills
c) life in uk certificates

1. Irrelevant question since no changes to settlement under economic route have been announced.
2. There is no question.
2. If your leave expires on 03-Aug and you make an application on 06-Aug then the application will be 3 days out of time and not 28 or 29 days in time.

If your current leave is expiring on 03-Aug and you intend to make an in-person application on 09-Aug for settlement, it will be an out-of-time application and will be refused.

also one last thing, i will be applying along with my wife as dependent. So, in any circumstances if my wife's visa is rejected, will they still issue visa for me?

Hi

In addition to above documents I would highly recommend you to have all of your P60's along with you for the last 5 years to show that you were economically active during your last 5 years stay on a Tier 1 Migrant Status. If you've got an odd one or two P60's missing for any year or years just try to get your employement history for the last 5 years from HMRC as the CW will definitely ask you about these documents as its an offcial requirement for all the applicants who are applying for ILR on the basis of Tier 1 G to prove that they were economically active for the last 5 years on their Tier 1 G status.

To the best of my knowledge the UKBA normally dont refuse the dependants visa if your wife has completed her 2 years time period in UK lawfully as your dependant and if she has also passed her LIUK test and if she hasn't got any Crimnal Convictions I dont see any other reason for the rejection of your wifes visa these are the normal things being assesed by a CW when issuing a visa for any dependant. I am just sharing my knowledge with you in this regard there's nothing concrete as I am not a CW and I dont really work for UKBA either.
