Hi Everyone

I have just read this on the UKBA website with regards to non-European Economic Area (non-EEA) nationals applying to enter or remain in the UK on the family migration route

can anyone shed some light please if this will apply only to those who will come to the UK on a settlement VISA after 9 July 2012 ??

or

if this applies to spouses already here in the UK on a settlement VISA??

Hi Imranh,
If you read the pages from 27 to 38 on the following link;

It will tell you that these rules for whoever applying entry clearance or limited leave to remain for dependent on or from 09/08/2012 not for the person who is already have these leave to enter or live in the UK.
However, if any dependent, who apply ILR from October 2013, should write life in the UK and English test at level B1.

thanks alot guys for your help - much appreciated.

Please see my background information below

my wife is Pakistani and is here on a settlement visa. She is not working i.e. is a housewife and I am permanently employed earning about £28k basic salary. My wife arrived in the UK in December 2010 and her visa expiry as appears on the passport is February 2013. She is currently on an ESOL level 1 course and has taken the speaking and listening test. She is currently studying the ESOL level 1 reading and writing course with a test at the end aswell. Before attending the ESOL level 1 course she took a test to gage her level of english and hence she was put on the ESOL level 1 course.

Therefore from reading the material pointed out in the posts above - Am I correct in thinking the changes do not apply to me?? (I know I am being selfish!!!)
