Urgent query about Tier 2 visa and break for ILR considerati

I am a work permit holder, my employment with previous employer ended in Mid May and my company informed UKBA about this on 19th May. I have not heard anything from UKBA about curtailment of leave. If I get 60 days from last day, it will be around 15th July. I have to apply for tier 2 visa. I was wondering if I apply from my home country before 15th July, will this be considered as a break for ILR calculation. I came here on work permit in Nov 2008 and 5 years will complete in Oct 2013? Kindly help.
