New rules for Partner visa or FLR-- Please help

i am writing you to get some advice for FLR (M) . i am on tier 1 general visa since august 2009 untill august 2012 (3 years) and wife is also on depentant visa untill august 2012 and living with me since nov 2009 (2 year+).

i was eligible for 10 year long residence in march 2012 and applied on 26 march 2012 and now waiting for my ILR. now in my understanding if i apply for my wife FLR after 9 july 2012 she has to stay with me another 3 years .

my query is that there is any possibility that i can apply for her FLR(m) before 9 july 2012 while i am waiting for my ILR to escape from new rule and then she can apply ILR soon after she got her FLR instead of wait for 3 years.

why is that your understanding? please follow the link in my post above and see points 1 and 2.

In addition according to the new rules from 9th July your wife will be able to apply for ILR once you have obtained ILR without having to apply first for further leave on form FLR(M) as long as she will complete her probationary period within the validity of her current PBS dependent visa. This is because of a change to the rules on ILR for PBS dependents which no longer require that the partner has to be applying for ILR at the same time as the main applicant. However if you have not been granted ILR before your wife's visa expires in August she will need to make an FLR(M) application and ask for it to be considered after your ILR application. This will still mean that she only has to complete 2 years and not 5.
