ILR Questions

I was told recently that I may have to cancel my holiday trip back to South Africa as I'm not allowed to be out of the country for more than two months in one year.
Is this true?

ILR is lost if the person ceases to be *living* in the United Kingdom. In addition, normally, a person with ILR can work on the basis that ILR will be lost if more than 2 years are spent outside the UK. This is not an absolute thing, but that is the basic premise. Within this 2-year parameter, however, the person still has to be *living* in the UK - in other words, one can't just make a short visit to the UK every 23 months or so to keep ILR.

As far as I know there is no provision that more than 2 months a year can't be spent outside the country. Where did you hear that? How long are you planning to be away for? In any case, on your return you will need, as always after being away, to be able to convince the immigration office that you are still living in the UK. This shouldn't be too difficult to do if you really are!

What I meant to ask was, I’m on a work permit at the moment and when I apply for my ILR, I’m not supposed to be out of the country for more than two months in my final year?

It's actually 90 days which is 3 months.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.
