ILR Application - Gap in 5 years visa (HSMP + Tier 1)

Post by pb78 » Tue Jun 19, 2012 10:13 am

All,

I am due to apply for my ILR as a Tier 1 General Migrant tomorrow. My 5 year visa comprises of 2 years HSMP + 3 years Tier 1 General Migrant status. My HSMP visa dates are 26-06-2007 to 26-06-2009 but my Tier 1 visa dates are 29-06-2009 to 26-06-2012. As you will notice there is gap of 2 days between by HSMP visa expiry date and Tier 1 start date. My Tier 1 leave to remain letter is also dated 29-06-2009. Though my visa runs for a total of 5 years, should I be worried about the gap? Appreciate the views of forum members.

Thanks,
pb

It's not a gap. You applied while your HSMP leave was valid and a decision was made after it expired, but your leave was preserved during that time. They can't back-date residence permits so the date will be the day on which the decision was made rather than the day your previous leave would have expired.
