Hello

I have heard a few stories from my friends/colleague who's done through this visa but as I know there are many experts in this forum, I thought I would ask here just to be sure....

I am a non-EU citizen and I have been living in the UK for past 7 years (students visa-PSW visa).
My post-study work visa is expiring next January 2013.
I have met my boyfriend who is German citizen 5 years ago and we are still together hence we are looking at Unmarried couple/spouse visa. (not sure if two are the same)

We have opened a joint bank account now, there are a few good evidences we can provide that we're in a genuine relationship but there are a few things I am confused with:

1. we are both living in London and would like to stay a few years longer, basically all we want to do is marry maybe next a couple of years but for now just to stay together in London. In this case which visa am I applying for? Is this EEA1/2 ? or is it just unmarried visa?

2. I've read there is something like minimum of 2 years you and your partner have to live together. We've only been living together 7 months so far, not 2 years. (as we were both students) Does this matter?

3. my German boyfriend has lived in the UK almost 5 years but not registered permanently. Does he need to do that? Where is the place to start to do so?

4. My boyfriend is self-employed. Does this affect on visa as well?


If you also know any good places for getting more clear information (apart from border agency)or a good lawyer to speak to please let me know, it'd be highly appreciated.

Yes, the requirement is generally accepted to be for two years of co-habitation.

Durable Partners
The following conditions should normally be satisfied:
The parties have been living together in a relationship akin to marriage which has subsisted for two years or more.
The parties intend to live together permanently.
The parties are not involved in a consanguineous relationship with one another (i.e. they are not blood relatives who would not be allowed to marry as this would constitute incest).
Any previous marriage (or similar relationship) by either party has permanently broken down.

Unless you get married now, otherwise 7 months is not enough im afraid.
Applied for EEA4 on 24/02/2012.
HO received on 27/02/2012.
Refusal received on 16/08/2012 dated 11/08/2012
At the court, the HO REP withdrawn the decision and asked me to send the DOC for the time before marriage.
PR dated 05/03/2013
