10 years ILR - Eligibility confusion

Post by mrhello » Wed Jun 20, 2012 7:35 pm

Hi,

I came to the UK in Feb 2005 with Entry clearance as a student.

History :

Feb 2005 - Apr 2006 - student (Entry clearance)
Apr 2006 - Feb 2007 - student (FLR)
Feb 2007 - Jun 2008 - student (FLR)
Jun 2008 - Jun 2010 - student (FLR)
Jun 2010 - Jun 2012 - PSW (FLR)
Jun 2012 - Feb 2015 - dependent of Tier 4 student (Entry clearance)

Breaks :

Not more than 14 weeks in various years. (longest of them was 4 weeks )
I always had a leave when exiting & entering the UK , in the last 10 years

Query is :

1. Have i broken my continuos residence in June 2012 by going out of the country & obtaining entry clearance in my home country as a dependent , even though i had continuos leave to remain while i was applying in my home country ?

2. If i haven't broken my continuos residence could i apply in country 2015 (provided 10 year rule is still available in 2015) ?

Your reply would be really valuable

thanks.

great , quick & upto the point response.

i really appreciate your help.

Am i right in believing , that the new june 2012 family migration intent published by home office , the current 10 year rule would exist, 14 year rule would vanish & they are opening a new 10 year rule with 4 X 30 months extensions & 1 final application for ILR ?
