Urgent help please... spouse visa refused

Salam everyone.
I got my uk spouse visa refused yesterday i applied on 09/02/2012 in lahore The ECO refused it under paragraph 281 (iii) which says that i have question about the genuine relationship with ur sponsor and i feel that you will not live permanantly with your sponsor in uk.
Infact we got married in january 2012 and before that we both were togather in uk when i was on student visa.
I am very stress about this objection and cant find words how it hurts me
can anyone let me know how it will be dealt in appeal and what would be the outcome and how long it will take....
plz help me to understand how this dust will be settle down..

first off u have 28 days from the day u collected ur pasport to appeal, secondly appeal process takes more time as u can probably see from my timeline. its upto u if u wana appeal or make a fresh application with added evidence of genuine realtionship.

what did u submit as evidence of subsisting marriage?

i am the applicant from pak but i lived in london before marraige the ECO was very much satisfied that our marraige was genuine even though my visa was refused on other grounds. here is what i submitted which was alot but i would rather submit more evidence then less;

-endorsed nikahnama with translated version
-FRC; family registeration certificate from NAdra
-6months of my itemised mobile fone bills showing calls to my huband's mob & landline
-6months of itemised mobile bills of my husband's mobile
-6months of email history i.e screen shots of emails exchanged between us + few email prinouts
-pictures from london of us together before the wedding at freind's parties and events
-pictures of nikkah i.e of the actuall nikkah ceremony + with all the family
-pictures together after the nikkah
-receipts of gifts exchanged
-evidence of money transfer from my husband

u can also submit greeting cards, skype logs, sms history etc

syma is correct wid the proofs she has mentioned.. please follow them and correct us mods if we r wrong in advising anywhere...

I was in uk for couple of years where i met my wife we knew each other nearly 3 years but in uk i was assaulted in a planned robbery attack which put me in very vulnerable condition though we got our certificate of approval from HO there but we did not use it due to my medical condition and we planned together to come in Pakistan and got married here. we came Pakistan together and we also provide COA with our application and explain it on my covering letter as well along with my medical reports from NHS. we have not provided any kind of communication between us as we were together there
I think certificate of approval itself was a clear evidence of our genuine relationship and secondly we travel togather i provided her entry stamp at Lahore airport and than photographs on our wedding and walima invitation cards etc
however can u tell me if new application is being submitted whether we need all the documents the latest one or which have been used before can be submitted in new application
secondly if i go for the appeal which documents will go with it i mean not those one which have been with the BHC in my initial application

Syma, the docs you have outlined are fine when its a "normal spouse visa" ( ie UK citizen marrying from IndoPak), however in this case OP was a student in UK and now wants to marry Brit.

The ECO will assume this marriage only took place for one reason and that is that OP is using this procedure to come and live in UK.

I don't blame teh ECO for having this assumption as they probally deal with thousands of such application. This unfortunately becomes a very difficult point to prove.If the ECO asked OP if he would live with their spouse in Pakistan, do you think he will say yes?????.

The ECO does not believe this marriage is genuine for reason i have explained and don't think it will last as soon as OP has gained entry into UK :(

i understand what ur saying but its not impossible to prove a genuine relationship like that. in my case it had been 2 yrs since i was in pak when we got married, i showed that even before marraige my fiance visited Pk to see me and family 3 times but i guess what i had in my favor was that i did not apply for a spouse visa the min i landed in pk, we took our time and showed a consistent relationship for those two years as well before the marraige.

when i had my interview the ECO did not ask me a single question related to us as a couple or our marraige instead i was hinted she's satisfied that our marriage is genuine.

jus travelling together and saying u were together in uk isnt enough, in ur case u need to give them as much evidence of u guys being genuine as possible.

if u are planing to apply again u need most of the documents to be updates e.g bank statements, pay slips etc plus this time submit proper evidence of subsiting marraige. if i was u i wouldsubmit way xtra evidence to b on the safe side. dnt forget applying again would mean u'd have to pay the visa fee again, if ur guna apply again i suggest u do it before 9th July as there are few new rules about maintenence being introduced for applications made after that date.

If ur going to appeal then all u submit is paper worl related to the objection the ECO has made as in the reason of refusal. Submit all the above evidence i mentioned if possible + if u guys stayed together anywhere after the marraige prooof of that would be good in form of hotel bills in ur name. there is a section in appeal form which lets u explain everything in details use that to say everything possible in ur support. my husband submitted a support statement from his side with the appeal aswell maybe ur wife can do the same.

p.s if u submit tghe appeal online it might be quicker.

We both lived together in a property in uk and we r getting the tenancy agreement which r on our both names
Secondly we r getting the prints of our emails which we r exchanging from time to time
She lived with me in my family house for more than 9 weeks before she left for uk to carry on with her job ....... A bit confused how to prove it
We went for muree for holiday after marriage we have the videos but no bills as we're not aware it may be useful in later stages
We talk on Skype will try to take it out and send it with the appeal
I think it's best to go with the appeal rather than reapplying the case......

jus write in you support statement that she lived at ur family home for that period , she can confirm it in her support statement too.
yes obviously appeal saves u from paying the visa fee again which isnt a small amount to begin with but keep in mind the appeal process can take 3-9months.
