Hi

My husband is a Pakistani citizen living in London on Tier 1 General visa (due to expire in February 2013). I am a US citizen and I live in London on a dependent visa with my husband (Tier 1 General Dependent – Due to expire in Feb 2013).

I got pregnant and we planned the delivery of our baby in New York so I came back to the United States and gave birth to my baby boy. My baby boy automatically became a US citizen and received his US Passport.

Now I am going back soon and before I travel with my baby, I need to know if my baby needs an entry clearance/visa to enter the UK ?

Or we can just go to London using his US passport and then on our extension application, We can add the baby to our applications to the home office ( I believe when my baby arrive at Heathrow, they will give him nearly 6 months entry any way so we will apply to the home office for the extension of our visas including our new born baby before 6 months run out )

So I appreciate if you guys can help to confirm if I can travel now with my baby using his US passport to enter the UK and then apply for his dependent visa and go for an extension before Feb 2013?

There is a large visa fee for a new born baby to apply as a dependent and Ideally I want to avoid that because we will have to pay for him before Feb 2013 any way... It will save us all the visa fee and processing time in New York, but while we save money I also want to make sure that our plans reside within the law and totally legal. I don’t just want to turn up at the Heathrow and get a shock that my baby boy cannot enter without a visa.

I tried to explain my question well but if you still don’t understand please ask.

Yes.
A person in UK as a visitor cannot switch to PBS dependant.

Hi Ruby,

The other solution can be that your son can visit as tourist for six month without any visa and then you can apply his Tier-1 from US later.

you are coming to UK to Visit.
you are normally and legally living in United States.

What do you need to do?

If you are coming to the UK for a short visit (up to 6 months), you generally do not need a visa.

However, you should bring documents with you to show our immigration officers when you arrive at the UK border.

Thank you so much for the reply... i guess i will have to get his dependent visa in New York because if he can not change status in the UK then it is going to be a problem and i will have to eventually apply outside the UK at some point so rather do it now...

UKBA wont let us save any money ....................... :(
