Tier1 extension or ILR qualify?

Dear Members, need your expert advice and review for my case below:

HSMP VISA stamped on my Indian passport on Nov 2007 ( valid for 2 years)

Later HSMP/Tier 1 Visa extended for Next 3 years ( From Nov 2009 to Oct 2012)

As per visa I m completing my 5 years of HSMP/TIER1 visa stay by OCT 2012 and Hope to qualify for ILR.

Problem with my case:

I was not aware about 90 days out of country stay at one time?

So I went to India in Feb 2008 and Back to London June 2008 nearly Out of country 110 days in one continuous stay ( this

stay was not related with any work or medical Issue just stayed with family)

Later due to rescission I was not in continuous Job and been visiting to back home quite frequently for different reasons..

Like My Marriage, then medical treatment, death in my family.. so on going family Issues and so far my out of country stay

all together is nearly 370 days since nov 2007.

Out of above stays one continuous long period stay was 110 days ( Feb 2008 to June 2008)

could you please guide me how to sort my visa issues?

I guess same but wondering if their any way to get qualify for ILR?
one more extension and then after 14 months Again one more BIG expenses for applying ILR...
