ILR FOR MY DEPENDENT.NEED HELP.

Post by mrirumali » Fri Jun 22, 2012 12:38 am

Hi Everyone, pleas help me out.

I came to the UK in 2001 as a student and my wife joined in the UK 2006 September as a student dependent. Now i got ILR 11th January 2012 on the basis of Long Residence and my wife got 2 years FLR(M) 6th february 2012.

My Question is that :
1. she can apply for ILR now?

Or
2. she need to complete 2 years on FLR(m) in february 2014.

What was your immigration category when you applied for settlement?

Hi,

I am on the same situation. I also contacted few people and they also saying that it should be continuous 2 years. In order to confirm i called home office, they have different stories, one saying you can apply for ILR other said you have to apply first get ILR and then apply for her FLR(M).

This forum is also suggesting that we can apply for ILR? No worries about continuous 2 years.

I am so much confused as well.

Any more comments on this would be helpful.

Thanks

It is not certain whether reference to "Relevant Points Based Migrant" in 287(a)(i)(d) and 287(a)(i)(e) includes PBS migrants in a category that does not lead to settlement (e.g. - Tier 1 (PSW), Tier 4).

So, if your dependant wishes to apply for settlement at the time when she completes 2 years stay in the UK including stay as PBS migrant and as spouse of settled person, consider getting a written confirmation from UKBA before making such application.
