EEA Family or Unmarried Partners Visa URGENT!!

Hi all,

I am Colombian and my gf is German. We've been living together for over 2 years now and have a strong and quite well documented application I believe. We've been preparing my FLR(M) Unmarried Partners visa application but last night while I was going through some info I ran into something I wasn't quite expecting. Turns out to be that my gf doesn't qualify as someone settled in the UK as she has only been working here for 3 years. We just didn't know that that's what they meant by "settled" so now we don't know what to do. We both live in the UK, I'm on Tier 1 (PSW) at the moment which expires the 16th of August of this year. As you can see we're running out of time and freaking out a little bit. I've read that it exists the option of applying as an EEA Family member but I've found the information on it scarce and confusing. I am not sure if I can do it whilst being in the UK. I was planning on sending my application by mid-july will it be a problem if my visa expires whilst I am waiting for the new permit to get back? I've read in some sites that she would have to make a "joint application" to be regarded as a resident or something like that. Can anyone please explain me what this means?? I am very worried about this, I would really appreciate any help you guys can give me.

You can't use FLR(M) or the UK immigration rules if you partner is not settled in the UK. If you are in the UK now, you apply for a residence card using form EEA2. It's good news in the sense that the requirements are much less onerous.
