Tier 1 to EU (Italian) citizen

Post by ggottfri » Sat Jun 23, 2012 5:45 pm

Hi,
I'm an American citizen in the UK currently on a tier 2 visa. Just recently I was able to get Italian citizenship through my family decent. I'll be getting my Italian passport in the next few weeks but I was curious to know what the procedures are for the UKBA regarding my tier 1 visa status. I obtained my Italian citizenship through the consulate in London so never had to leave the country. Does anyone know what steps I have to take in terms of notifying the UKBA? Would I have to leave the country and re-enter on my Italian passport? Any thoughts would be appreciated.
Cheers

A confusion!

Do you wish to apply for settlement in the UK? If so, when will you become eligible for it (as a PBS migrant)?

Hello,
I don't need to apply for settlement since I now have Italian citizenship. As an EU citizen I have the right to work and live in the UK without a visa. However, because I received my Italian citizenship while I was living in the UK on a tier 2 visa I just wanted to know if there is a procedure to notify the UKBA that I no longer need by tier 2 visa.
Thanks.

AIUI and I stand to be corrected, by virtue of your Italian citizenship you'll only be able to apply for PR (settlement under EU directives) after 5 years of becoming an Italian citizen.

On the other hand, you may be eligible for ILR (settlement under UK laws) sooner depending on when you complete 5 years in an immigration category that leads to settlement (e.g.- Tier 2).

It is for this reason that I had asked the questions.

Options:
1. If you wish to now switch to living in the UK as an Italian citizen under EU law, you do not need sponsorship to work. Therefore, you must inform your sponsor about it so that the sponsor can inform UKBA as they are obliged to do.
2. Continue as a Tier 2 migrant until your current leave expires and near to the time of expiry inform your sponsor that you no longer require sponsorship to continue working.
3. Continue as a Tier 2 migrant until you become eligible for settlement (under UK law) and apply for settlement as an American citizen.

Thanks, I guess it will be option 1 as there is no point in having ILR or applying for settlement since I'm now an EU citizen. I'll have my employer contact the UKBA. I'm sure I'll have to turn in my biometric card as I won't need it. I'll be glad to be rid of it!
Thanks for your help.
