Need some more details:

Where are you from?
What basis are you here on?
How did you arrive?
Have you had any other gaps?

Unfortunately, a costly mistake.

The only option is to apply for settlement visa from outside the UK.
If you can, do it before 09-Jul-12, else you will be subject to the new rules.

now this seems strange...i have no life outside of the uk...my life only exists here....is this not against my human rights and separation of family...this cannot be the only option...i have built up ten years worth of life here....what about article 8 under eu regulations.....I know it is a mistake.....i am the one that made it...but to be able to remove someone from the only life they have must be wrong....now i had someone from kings court chambers say Np ....but they were really pushy and want £1350 pounds real fast...now that sent up red flags....do you know anything about these guys.....will speak to a solicitor on Monday...appreciate your advice...but it does not make sense....any others here who might know or who can recommend a good immigration solicitor

FLR(M) application requires valid leave.

As for FLR(O) application (DL), the following applies:
Statement of Intent wrote:15. A person who does not meet the requirements of the Immigration Rules will no longer be considered for Discretionary Leave outside the rules on Article 8 grounds.

133. Those who, before 9 July 2012, have applied for initial or further leave under the rules in force prior to that date, but do not qualify for it, will not be considered under the Discretionary Leave policy. If they do not qualify under the rules applicable to them, their application will be refused. Any fresh application on or after 9 July will be considered under the new rules.
