checklist of documents suggestion for EEA2 & EEA1

hi mates,

I just want to know that the following checklist of documents are adequate for applying EEA2 and EEA1 family permit inside the uk. My wife entered uk 3 months ago and i am living in uk for the last 5 years on tier1 visa which has further expiry date of 1 year. kindly tell me the following checklist of documents are adequate if my EEA national wife excercising EU treaty on economically self sufficient using my savings and job income.
1. EEA1 AND EEA2 FORMS WITH PICTURES.
2. MARRIAGE CERTIFICATE
3. NON-EU BANK STATEMENT (7 MONTHS £5000 END BALANCE)
4. EEA NATIONAL BANK STATEMENT (2.5 MONTHS £1330 END BALANCE)
5. PRIVATE MEDICAL INSURANCE POLICY DOCUMENTS COVERING BOTH OF US BUT OUTPATIENT TREATMENT HAS BENEFIT LIMITS
6. EEA NATIONAL ENTRY TRAVEL TICKET
7. NON-EEA PAYSLIPS (6 MONTHS)
8. 2 COVERING LETTERS INDICATING THAT EEA NATIONAL IS SELF SUFFICIENT BY USING NON-EEA NATIONAL SAVING AND JOB INCOME. AND ALSO TELLING TRUTH THAT EEA NATIONAL IS NOT REQUIRED TO EXCERCISE EU TREATY IN 1ST 3 MONTHS.

Are you holding Tier-1 General visa or PSW?

You should be aware that your ILR clock will effectively reset if you switch to EEA route as time before your wife came into the UK is not counted.

But ILR is totally depend on the 10 years lawful status irrespective of visa type and moreover, even the visitor visa time is also considered for that. Under ILR rule an applicant must have been resided in uk lawfully irrespective of visa type for 10 years. The following conditions reset ilr clock:
1. deportation order
2. out of time applications in 10 years but 1 time out of time application for 10 days is pardonable.

OK. If you are on PSW, then this is less relevant (for Tier-1 General ILR can be applied for after 5 years). You are right about the 10 years ILR rules (although if you switch now to EEA route, there is no reason to pay for ILR in 5 years time as PR under EEA regulations is free).

As for your documents, it all seems fine. Just make sure that if your bank account is not a joint one, then you declare in your cover letter that she has access to the funds in the account.

thanks for reply.

we have not joint accounts but i made nearly 7-8 transactions of bank transfer to EEA national account about which i have clearly mention that she is regularly receiving funds from me. And I have attached mine 7 months but eea national 2.5 months statement because she came 3 months ago. And my private insurance policy has started just before she completes her 3 months in which EEA national not need to excercise treaty and its 1st payment will be deducted in next month but not now. is that alright you think.

Would that be the first payment? Or did you pay anything already? (I would normally think insurance companies tend to charge in advance). No idea how HO evaluates the insurance. There was a report of CSI rejected because the CW could not see monthly payments for it although the applicant have submitted evidence he paid an annual coverage in advance...

Actually I bought private medical insurance policy 1 month advance which start date was in June and company agreed to deduct payment in july. Moreover, I have also attached a letter insurance company confirming that such amount will be deducted each month starting from july to onward every month's 1st date. That letter confirm my bank details and look like an agreement/contract for payment.
does it sufficient if UKBA think about insurance policy payment.

No idea (you never know with the HO). I suggest you submit what you got and see what they say.

you absolutely saying right.
But what i believe is that it does not matter to see the payment of private medical insurance policy rather UKBA just calculate that either the applicant has got sufficient balance/saving in bank to pay insurance policy and other expenses.

My Rc was refused in may due to medical insurance ,I paid the full amount in advance and this is also mentioned in my policy documents but as HO has a habbit to give control to visa officer to reject any application unlawfully so they just find any reason ,so just to be on a safe side get a letter/financial statement from your insurance company which clearly says the payment plan and if you have any evidence of first and the recent payments in your bank statement than it would be great as I am going to do the same in my appeal..best of luck,,

But in my case I have already sent them a medical insurance company letter very clearly mentioning the payment plan with the dates when exactly they will deduct money. Actually I bought medical insurance policy 1 month advance from the actual start date so perhaps due to company financial policy they given me the option that they will deduct the monthly direct debit payment from following month. About that letter I have already told to ukba in my covering letter that along with private medical insurance policy document I am also attaching the payment agreement plan. I think its just a common sense that if am applying in june then obviously no payment will be shown in bank statement.
are you talking about this letter.
