ILR - continuous stay short

Post by flakes » Mon Jun 25, 2012 4:50 pm

Please can anyone who has applied for ILR help with my query. I was granted HSMP visa clearance on Sept 19 2007 but I only arrived in the UK on December 7, well over 2 months but less than 3 months. My total time outside the UK since arriving is 113 days spread over 4 years. My current visa (tier 1 General) expires on Sept 19 which is 2.5 months short of 5 years.

What can I fill in the form where I am required to indicate if I have spent 5 years continously in the UK when applying for ILR

Based on the information you have provided the answer would be "Yes".

I presume the question you are referring to here is the one below?

"D1. Please confirm whether you have spent a continuous period of 5 years lawfully in the United Kingdom:"

I could answer your query but I'm British so have not had the need to apply for ILR. Therefore I don't I meet the requirements you have stipulated.

flakes, I'm guessing the point being made here is that, you will restrict the number of responses you get if you are only seeking answers from those who have applied for ILR before. I'd actually have to retract my response if I had stuck to your requirement, as I have not applied for ILR.

Lucapooka/cs95tdg - thanks for your response. just understanding how the forum works as I am new. Please can anyone with answer help. the real question is if I should apply for ILR or extend for 3 months as total of time outside the UK (inclusive of delayed time before entering the UK) is about 195 days.

Thank you

To begin with, read FAQs for ILR - WP/Tier 2/HSMP/Tier 1 - Read before posting
