Hi, I'm a newbie. I'm desperate for some help. I've read through the boards, but have a query. I am on a spouse visa, my husband is a British.citizen. we had a baby in Oct and claimed child benefit in his name. I am applying for settlement this week and read the details of my Biometric residence Permit requirements...it says that child benefit and tax credits are public funds that I have no recourse to. It also says j can be prosecuted if I receive them.
It mentions that my sponsor cannot receive them on my behalf either.
Is this going to affect my application. Can I do anything about it? Thanks so much in advance.

Your British husband is entitled to claim child benefit for your son. Assuming he's claimed in his name this won't affect your ILR application. If he's claimed in error in your name, ask to have it changed into his. It won't be a problem.
