Tier-1 dependent visa refused - Please help

Tier-1 dependent visa refused - Please help

Hi,


My wife's tier-1 dependent visa was refused on two grounds

1. Three Months bank statement was not produced:
We had submitted 6 months worth of bank statements(3 Jan to 15 May 2012). Out of these 3rd Jan to 06 Mar were duplicate statements stamped with Barclays official seal. 06 Mar to 1 May was original bank statements and from 1 May to 15 May was again duplicate statements stamped with Barclays official seal.

They completely overlook the statements from 3Jan to 06 Mar.



2. Visitor visa refusal :
My wife had applied for a visitor visa thinking she can travel with me soon after marriage. This was also applied because my tier-1 was due for extension on 1st of September. I thought if the visa took a month to process (assuming we apply in June after we get the marriage certificate etc), she will only have 2 months of validity on her visa as dependent visa expiry is tied to husband’s visa expiry date. The mistake that we did was, when she applied she said she was going to visit friends. She had applied for the visitor visa on 06th of April and she had mentioned she is planning to go to the UK for 1.5 months. They have objected saying that if you were intending to travel for 1.5 months to UK you couldnt have got married on the 12th of May.
(Excerpt from the refusal letter - I have noted that you were refused a visit visa for the UK by our office on
16/04/2012; you stated in this application that you were going to visit friends in the UK for 1.5 months but you failed to provide sufficient supporting documentary evidence to show that this was the case. I have also noted that had you visited the UK when you proposed that you would have been in the UK until at least the beginning of June. You were married to your spouse on 12/05/2012. I am led to question your reasons for initially wanting to gain a visit visa to the UK given that you would have been in the UK when you were supposed to be getting married.)

We had clearly mentioned why we applied for visitor visa then. We had mentioned that we applied so that she could travel with me and because my visa was up for extension on 1st September. Looks they didnt look at this.

Please please... help me how I should re-apply.

Also will this have any impact on my extension and her intention was doubted and will this have any effect as she is my wife?

Apply for entry clearance as dependant of PBS migrant.
If the application is submitted after 08-Jul-12, your wife will be subject to the new rule.

No effect on your application / extension (irrelevant).
