WORRIED ABOUT MY WIFE ILR

Post by nrngrg » Wed Jun 27, 2012 3:19 pm

Hi there,
I am ILR holder. I have a child from my previous marriage. Last year I got married and my wife is here from sep 2011 on my dependent visa ( ILE ). After couple of month unfortunately in bad circumstances I had to claim WTC/CTC/CB. working tax credit is in my name, Child tax credit is in my wife's name. My wife is still unemployed, she has to apply for ILR by Nov 2013. Could you please advice me these tax credits will effect on ILR process??? I am worried of this tax credit. What should I do now, Do i have to stop all claims???

Dependant visa or ILE?

If she has ILE, then she does not need to apply for ILR.

Then she does not have ILE!

Best that you post what the endorsement (on the visa vignette in her passport) exactly states.

The observation is confusing. The answer to the following questions will help clear the confusion.

Did you and your spouse live outside the UK for 4 years preceding the spouse visa application, and did you marry your spouse more than 4 years before the visa application?
Did your spouse pass the LITUK before the visa application and provide the evidence at the time of visa application?

Child and working tax credits must be claimed jointly. There is enough time to sort the matter out before your wife becomes eligible and applies for settlement.

I have been here since 2000 and she was outside the uk, we got marry just 4 month before the visa application and she had just provided immigration requirement basic english test (A 1 level )

Then the ILE observation is an error. Your wife has the standard 27 month visa as a spouse of a settled person or British citizen.
