Tier 2 Application Appeal

Post by Niki11 » Wed Jun 27, 2012 10:30 pm

My friend had made an appeal for his Tier 2 Visa which was refused on salary grounds. The hearing date has now been confirmed in July. As per the solicitors there are 90% chance to win the appeal. If the appeal is in favour can anyone suggest how long it will take for him to get his Visa stamped from the date he received his decision.

Visa or BRP? Was this an application inside or outside the UK.

Unless there was a fault on UKBA's side - there is no way the appeal will be allowed ! I am sorry, but I have been through exactly the same process a couple of months back and I believed I had strong case as my rejection was on salary grounds as well. Lawyers will always tell you what you want to hear that's how they stay in business !
If your friend can afford a new COS, I would say withdraw the appeal and make a fresh application OR leave the country and make an out of country application if the employer is willing to do the RMLT and issue a restricted COS.

Answering your question: it normally takes 2-3 weeks for the judge to deliver the decision after hearing. I am not entirely sure how long will the BRP take to arrive after the appeal has been allowed.
