Wifes visa, urgent help required

Post by AG30 » Thu Jun 28, 2012 12:28 pm

Hi people,

Tried looking for the answer but couldnt make heads or tails of it.

I'm a british citizen, wife's spouse visa was issued in may 2010, she entered uk in july 2010 and visa expires august 2012.

A few questions -

1) am i right to say we need to apply for indefinite leave to remain? - set m?
2) a friend mentioned she can apply for her ilr 28 days before the end of her 2 year probationary period - ie, june 2012, (arrived july 2010)

3) a little more complicated...given the rules change on 9th july i am trying to apply as soon as possible...but... she's completed her esol although still yet to receive certificate from city & guilds, ive paid £50 for a fast track result but it will still not be here until 4th -5th july (no guarantee either).

I take it I need to prove she has passed therefore i HAVE to show the certificate....therefore I have to wait until i receive it to send it off.

If I use special delivery via royal mail and send on the 5th to arrive guaranteed by the 6th would that entitle me to be judjed by pre 9th july rules or should i go for premium service?

Your help would be very much appreciated

1. Needs to? No. Wishes to, then yes.
2. No earlier than 28 days before the 2nd anniversary of her entry in the UK.
3. The new rules have no affect.
