Visa for my wife

Visa for my wife

Hello. I have been reading on this forum for a very long time; knowing that one day my time will come. I got married last year; my wife, at the time was only 19 years old - immigration law at the time was that she had to be 21 in order to apply for a settlement visa in the UK. My wife is an indian citizen and I wanted her to be with me soon after the wedding so I brought her over on a family visit visa (which was declined on first application; but successful when i applied again).

She is now back in India preparing for her english requirement tests so that we can apply for a visa at the end of July. I have strong doubts on the situation on finances. I am currently employed in a recruitment firm for the last 2 years and my basic salary is over 23K and with commission, I am earning around 29K p.a. Over the last 3 months, my bank account had been extremely damaged (I mean, going into minus for two months). A few reasons include a trip I made to India because I genuinely missed my wife and wanted to see her and a few others relating to our relationship.

Would this be a factor that may reduce the chances of my application being successful? I have checked and if my wife passes her english tests; we have all documents in place and all requirements met apart from a clean bank statement. During the time my account went into over drafts; I still had my savings which I could have used to clear it. But I wanted to keep my savings untouched (even though its not a lot).

Please advise.

Submit your savings account statement with your bank statements and you should be fine.

Even though, I have only been saving about £100 a month... sometimes less, sometimes more over the course of the last 2 years... at the moment, its adding upto around £1500.

Well... its not gone beyond -300 but only stayed like that for about a week each month.... and that is during the month of April, May and June....

it has never stayed overdrawn for a continuous period...

I also applied in India for my wife, my bankstatments are very messy (not over drawn like yours but very messy, I am always moving money in and out, so my actually balance in the account is never over £100 at anytime Apart from the day before my DD's go out. But I just write a cover letter to explain this and also put my savings statements in too.

I would suggest providing more statement then asked (I put 12 months worth), a cover letter explaining you earn £29k and why you had gone over drawn etc (going out to see your wife etc) Just be honest. And also provide those savings statements.

Also get a letter from your employer if you have not already confirming you are still employed, so you have a letter from HR or your boss with a recent date but also your employment contract too, yoru salary and how long you have been employed.

Also where are you planning to apply?, if you look at my profile and see my previous posts you will see a list of my docs I provided and also dates etc. I applied in AHM, Gujarat in March.

Also there is a topic for India on this forum which is good to follow....

Where do you work anyway? I am also in recruitment?

The application will be submitted in Chennai.

There is a paragraph on the Statement of Intent:

79. The Government is not looking to draw up a personal financial balance sheet for each
sponsor (outgoings, credit card and other debts, mortgage, etc), but taking £18,600 as a
benchmark for financial stability and independence on the part of the sponsor or the
couple. We recognise that their circumstances may change over time, so they will be
reassessed when the applicant applies for further leave to remain and for indefinite leave
to remain (settlement).


I'm not understanding what this means. I've heard of situations where the applicant provides more information that necessary which could turn out to be a negative thing - which could affect the application. - is this true that we don't have to provide a statement of income and expenses anymore?

Thanks pazpatel - I have already enquired with our HR dept and they will be doing a statement of service along with contract and pay details - they usually do this for mortgage applications so that they'll probably use the same template for me. My manager/boss will also write a back up letter. I am working for HCL - healthcare recruitment.

Pazpatel - how long did it take for your application to be processed? (i will check your posts as you suggested) thanks.

New problem - Employment Contract

Ok... I thought everything was ready until i received an email from HR saying they don't actually have a contract in file for me!?

I don't know why she makes it sound like its the end of the world, but I told her that my contract was transferred across from the previous owners of the company etc, but she said they had nothing in file and that she didn't know what to do about it.

So what happens now; can I use the email conversations with HR as evidence to explain why i haven't submitted or should HR create a duplicate contract for me?
