EEA residence card

Hi everybody. I have read a lot of the things you wrote, and the information were really clear and useful. However, I do have a question. Does it matter if my husband just has a residence card. He does not hold any passport. Will we still be able to travel to France? (we are planning on traveling by ferry, not airplane). But if in the future we want to fly, will it be a problem that he does not have a passport? I forgot to say that it is an extended family member residence card that he has.

Hi juulye62,

yes, that is a big problem. Without the passport you cannot travel, and depending on where you are resident it is even illegal to be without a valid passport.

In either case I would suggest to get a new passport ASAP, as it may be too late to obtain one should you suddenly need it.

If you tell us which country you are in, someone might be in a position to tell you if not having a passport is illegal in itself.

I am living in the UK. I have a passport, it is my husband who does not have one. He cannot get one because he is from Iran and he ran away from there a few years ago. When he arrived in the UK, he made a claim as an asylum seeker but his demand was refused, and in his refusal letter, the judge said he should apply to get leave to remain in the UK as an extended EU family member, so we got married and applied. The only ID he has got right now is an ID card povided by the Home Office stating his name, date of birth and country of birth. We've been to a lawyer to make his application to remain in the UK, but the laywer never saida thing about him not having a passport. You are kind of scaring me here..

In the UK you are not obliged to have a passport, so nothing to worry about.

If you want to travel this might be a problem. You can try to get a "travel document for refugees", which can be used for travel. But I don´t know the details about how these work.

Are the Iranians well enough organised to realise it´s him? Otherwise, maybe the Iranian embassy will give him an Iranian passport? You can always try, in the worst case scenario they´ll kick him out of the Embassy...

Maybe he will be eligible for British citizenship soon?

Depending on your nationality, he may become eligible for the nationality of your country at some stage...

I´m just replying to make sure you´re not worried: As per first sentence, in the UK you´re not obliged to have/possess any ID.

Thank you for your reply. I just sent a message to the french embassy, explaining our situation, and asked if he will need a visa. I'll let you know what they said when I receive their answer, as it may help other people in the same situation

What nationality do you hold?
