10 years ILR - gap in leave

Post by nilgrade » Sun Jul 01, 2012 2:52 pm

Hi,

I have a query on ILR continuous lawful residence . I skimmed through some posts in this forum but none of them are quite specific to my scenario , so i decided to post mine . My immigration history is as follows :

Sep 2002 - Nov 2004 = Student visa entry clearance in india

Nov 2004 - Jan 2008 = student visa extension in the uk

jan 2008 - mar 2009 = student visa extension in the uk

mar 2009 - apr 2011 = psw visa in the uk

may 2011 - apr 2013 = dependent of student visa , entry clearance in india

My problem occurs when i went to india with my spouse in april 2011
my PSW visa expiry : 27/04/2011
date we left the uk : 01/04/2011
my dependent application in india : 04/04/2011
came to the uk tier 4 dependent : 06/05/2011

I only have a maximum time of 85 days outside uk in the last 10 years .

my real worry is , while i was in india , i had leave until 27/04/2011 , i applied in india while i had valid leave (04/04/2011) , but dependent visa entry clearance granted on 03/05/2011 , came to the uk 06/05/2011 , I HAD TIME SPENT IN INDIA BETWEEN 27/04/2011 TO 06/05/2011 , WILL IT BREAK MY CONTINUOUS LAWFUL RESIDENCE ?

your comments are really appreciated
