ILR Set O (JR) waiting time

Post by lovely_chap1 » Wed Jul 04, 2012 12:23 am

Hello Every one: I 'm new to this forum. Just wanted to share my panic experience of waiting long for the result for my case from UKBA. I have applied for ILR on 5 years completion of my HSMP, (JR). My application details are as below.

Postal Application submitted: 13 Jan 2012
Acknowledgement letter received: 17 Jan 2012
As of now on 3 July 2012 - Still Waiting - Almost 28 weeks

I'd appreciate if any one can advise what should I do as my employer is continuously asking for my new visa and insisting for new acknowledgement letter from UKBA every 3 months. I have sent a written enquiry to UKBA through my solicitor hence over a month no reply from them.

Ask your employer to use the Employer Checking Service to confirm your immigration status and right to work in the UK.

ILR Set O JR waiting time

Thank you for your reply Sushdmehta. I already offered to my HR manager that they can do my right to work status check but he said if they do my check, they will get a general answer that 'my case is under process and they can't confirm my right to work status' as my visa has expired since i have applied for ILR and if they (my employer) don't get confirmation for my right to work then they will most likely terminate my contract. That's why he suggested me to get a fresh acknowledgement letter which I requested in written to UKBA but no reply hence it is over a month now.

Click on the link and read the information therein. You will note that the Employer Checking service does not provide "general answer" but "specific answer" on the immigration status and right to work of the person in question.
The service can also help an employer to check an applicant's right to work if the applicant cannot provide full documentation because they have an outstanding application or appeal with us.
If you are expecting UKBA to send you a duplicate acknowledgement letter, IMHO, you may be expecting the impossible. And an acknowledgement letter will only prove that you have made an application ... nothing more!!

You are right but I did exactly I was told to do. So in your opnion I should offer them to make any checks they want, on my RTW status as I can't provide anymore evidence and since I hold same RTW status as i had prior to my visa expiry until I get an answer from HO, it will be chellengable if they suspend/ terminate my contract.

Any idea how long will it take to get my passport back from HO. It has been almost 28 weeks now waiting.

Is your ILR backdated to when your previous leave to remain finished, or is it for June, in which case you would have to wait longer for your naturalization?

I wish it was back dated but unfortunately my time period for naturalization starts the date my ILR was stamped - 29 June.
