upper tribunal appeal allowed

Post by aysie » Thu Jul 05, 2012 12:32 am

hi guys
just wanted to see if anyone can give me some information regarding our immigration problem.
my husbands appeal was allowed at the upper tribunal on the 4th may 2012, the judge has significantly stated that the case should have been allowed from his first application and is disappointed that the home office has wasted our time for nearly 3 years.
our solicitor sent the home office a letter when the time period for the home office to appeal the decision was over, in the letter he says, that given the circumstances he requests that my husbands passport to be returned and be regarded as urgent. in total now it has been 8 weeks, i rang the home office 2 weeks ago and was told that we should hear from the home office within three weeks of them receiving the letter from the court.
a friend of mine has suggested we seek advice from our local MP as they can sometimes have an influence on these things.
my husband was granted discretionary leave.
i would like to know your stories and waiting times

thanks guys

x

Peppekale, after contacting your mp how long did it take to get a response from the home office? And what exactly can the mp do? Thanks

All mps have special line to UKBA.All queries by mps must be replied to.I received my ILR within 3 weeks after contacting the mp.Can i also say some mps are not sympathetic to immigrants but they still have to help you.

we went to see our mp on monday, they said this seems to be occuring quite a lot. they said it can take upto 2 months to receive a response from the home office, but its normally in 3 weeks. can you tell me whether he will have to go to the home office for biometrics and what a BRP is?
also we are unsure if my husbands passport has expired, did you receive your documents 3 weeks after contacting your mp?

thanks

I waited for 3 months for UKBA to implement the appeal.I then contacted my mp as well as the team that was holding my passport.

I received my documents in three weeks after contacting my mp.UKBA will contact your husband regarding his biometrics.

More details on BRP (Biometric residence permit) here http://www.ukba.homeoffice.gov.uk/sitec ... rocess.pdf

hi guys just an update for anyone who is interested or in the same position

we saw our local mp on the 9th of july, who was going to contact the home office and make enquiries as to why we still havent heard anything from them.
i telephoned the home office last week and the status of my husbands papers were incompleted.
we have to wait till next week before the mp will telephone or write again once its been 4 weeks.

What is taking so long :(
