Appeal against Entry clearance decision

Post by jaire26 » Thu Jul 05, 2012 10:59 am

I recently made an application as a family visitor, provided my personal circumstances as required on the UKBA site, my sponsers documents and letter of invitation baisically in short all that is required of me, as stated on the supporting documents guidence. I submitted a letter from school stating I am a student at the university as required, also added a reference letter from one of my lecturers of a subject I undertook during the last semester, as well as a certificate of honours for the previous semester, even though they just state a letter from your educational provider, thinking that should be enough as they will probably enquire. But to my surprise I was turned down because of the following reason, though they state they were satisfied with everything else.

''It is your current personal circumstances and intentions which are paramount in considering any application, You only arrived for studies in your current country last year ın September 2011, you have provided a letter from your university stating that you are enrolled on a 4 year bachelor degree course and expected to graduate in June 2015, if you pass all the required exams, however you have not provided any evidence to show that your studies are progressing and that you are up to date with the required exams, I am therefore not satisfied on the evidence provided that your studies are ongoing. I have tried several times to contact the university and have also sent an email to the address given on the letter provided by you, but to no avail. You have failed to demonstrate that you have sufficiently strong social and economic ties to the country of your current residence or any other country outside the UK, to satisfy me that only a short visit is intended. This leads me to doubt the reason for your visit and question your intentions in travelling to the UK now. In overall assessment of your application, I am not satisfied on the balance of probabilities that you are genuinely seeking entry to the UK as a general visitor for the reason or limited period stated and that you intend to leave the UK there after.

I am an international student here in Cyprus and I understand I only came last September for purposes of study, that was the begining of the academic year. now at the time of application we had just closed and ended the academic year for the summer holidays, concluding my first year of studies. ı have a student permit, I am studying and was just planing on going to the UK for a few weeks during the summer break, is it not allowed? did I miss this somewhere?

They state they called the university to enquire and to no avail, this is a total lie! I applied on the same day as my collegues from school and they got thiers! how is it when it came to my application they didnt get a response from the school? even submitted a reference letter from a lecturer of one of my subjects in the last semester but I suppose they turned a blind eye to that. They need to break it down totally of what they require, and if there is something missing they should let us know and we can just scan and email it to them. to begin with it was not one of the requirements, and there is no limitation as to the lenght of stay for you to apply if you are not applying in the country of your usual residence.

Therefore just need advice from anyone out there, I m sure you may understand my position. Need to know whether I should appeal, and what do I submit when I apeal, should I submit evidence that I am really in school and up to date with my studies? as this is the only reason for denial. They state we tryed calling the university but to no avail, how do I prove this is false as this is a reputble university on the Island, and it is rare for calls not to be answered unless they did not call during office hours, or the Admin head was not in his office for which I doubt he is the only one who can answer thier quiries. What are we supposed to do if they state they want a letter from my educational provider, then they state we refused because yes you submitted the letter but we couldnt get through to the school is that my fault? and you didnt submit any proof of ongoing with my studies. when I recieved the letter from school a week before submitting my application, If I was not in school dont they think the school wouldnt give me a letter stating I am enrolled with them? Would prefer to apeal, hopefully they may reach a decision before the summer is over in September if not well.........

thank you for your time, what frustrates me the most is that those who are not genuine apply and recieve thier visas and end up there...but the genuine ones are turned downed, what an excellent job they are doing!

If you appeal it will take months for your appeal to be heard. You could re apply again giving evidence of your academic progress and proof that they have not contacted the university and provide all the documents that prove you are a genuine visitor and have strong ties with your country and are committed to your studies.

Alternatively appeal submit the documents i have mentioned and hopefully the entry clearance manager will give you clearance after seeing your bundle and the case won't go before a judge.

Reapply rather than appeal. Give detailed explanatory points on which you were refused and if you have any more evidence attach that with new application such as any long term fees fees that you have paid for your studies.

Give accurate details of people whom they can personally contact at your place of study to confirm that you are indeed studying there.

What is your nationality by the way, as some people are likely more than others to get refused simply on the grounds where they originate from.

Appealing will take a long time, and you will only probably get a paper hearing ( as you are not in UK and you don't have sponsor)rather than oral hearing in which you could argue your points much better.
