Hi all
Thanks in advance and hope someone can advise. I am very stressed as received the following letter yesterday which is very vague.
This letter was date 02-July-2012 and received yesterday afternoon 05-July-2012

01. Current Visa - Tier 1 (General)
02. Date of expiry of current leave: 05 May 2012
03. Number of Dependent: One
04. Date application posted: 03 April 2012
05. Date application received at UKBA: 05 April 2012
06. Date payment debited: 11 May 2012
07. Payment mode: Cheque
08. Acknowledgement letter received: 19 May 2012 (Dated 15 May)

received the following letter on 05-July-2012 (dated 02 July 2012)

09. Biometric letter received:
10. Date of Biometrics enrolment:
11. Date Passport & documents received:
12. Date BRP received:
13. Date (new) leave to remain valid up to:


Letter is as follows.

Thank you for the application(s) for leave to remain, which has been identified as invalid due to an error or omission with regards to the mandatory information and/or documentation that has been submitted in support of that application.


We are therefor asking you to submit a new tier 1 General application form. The application form you originally supplied is out of date.

Please note that we are only able to accept the original documentation(s) received within the UK Boarder Agency within 7 Calendar days of this notification. We therefore strongly recommend that you send the document(s) by special next day delivery.

no further extension will be given if the requested information is not provided by the deadline. If the information requested is not provided within 7 days time frame period specified the application(s) will be rejected as invalid.

Please be aware that if the attempted application is rejected as invalid under the Immigration Rules, a fresh application can be submitted. The date of the new application(s) will be the submission date of fresh application form(s), that is the date that it is posted, delivered by courier or accepted at a public enquiry office. Please also ensure when submitting a fresh application(s), that any documents enclosed cover the dates relevant to the fresh application(s) (the date of the resubmission)

If the fresh application is submitted after the leave to remain has expired, the appeal rights will be affected in the event that the application is refused. Tier 1 General and Tier 1 Post Study have now closed to new applicants and if the scheme has closed before the fresh application is submitted, it will no longer be possible to lodge an application in this category.

Upon receipt of the requested information, an invitation will be sent to attend a Biometric Enrolment appointment.

I a very upset as I received letter on 4th day and today is 5th day.
1- Does it mean that they have mistakenly considered the application form out of date although application was delivered to them by Royal mail on 05-April-2012 (before forms were changed)
2- Do I need to complete new form for myself only or also for my wife? along with extra photos?
3- how can I complete application forms requirement as in Paying fee, Bank statements, Payslips, Degree etc as they are already with them?
Should I pursue it further via solicitor? and do I need to fill change of circumstance form to notify them for having assistance by solicitor/representative?

try giving the call to Home Office....and if possible speak to the case worker explaining him the application form is not invalid as it was sent by post before 5th July...HO website clearly states that if the application is sent by the post and date of posting is considered as the visa application date

Prior to 6-April-2012, though the version of the Tier-1 dependent form remained same, however some members have identified that the sequence of questions of the BRP details section were altered that has an effect on not moving forward to BRP invitation from UKBA

It might be possible that you are affected by this.

Hi Newfax,

This vague letter could be really disturbing. Please I need you to calm down and look thoroughly into your previous application form submitted and check whether you did not tick or answer some questions asked in the form.

Will advise you at this point to respond UK Borders reply as requested.

By the way have you had your biometric done before you received this rejection (vague) letter?

Do you have a copy of the form that you submitted? What version does it say it is?
