Documents were returned

Post by diane » Mon Jul 09, 2012 10:05 am

Hi EEA2 applicants

My documents were returned because it was 'insufficient'. I am applying under the unmarried partner category.

HO are asking for a joint tenancy contract which I have already provided or the banks or utility bills.

I am assuming that because my tenancy agreement was stated 'assured shorthold tenancy agreement' rather than 'joint tenancy agreement' although both my name and my partner's name are on it. Can someone help me?

I can only provide this joint tenancy agreement as this is the only document we have covering our two years living together. We do not have a joint bank account covering two years. If I try to get the landlord amend the contract accordingly, will this document be sufficient?

Someone please help me

I presume the HO wants more evidence to show you are having a relationship akin to a marriage and not just sharing a flat.

Have you got utility bills under both of you? Any other financial activity under a joint name?

The utilities are all inclusive in this joint tenancy. We only opened a joint bank statement in May 2011. My partners bank statements is addressed to a house(not where we live) which he has purchased early last year.

Another thing to note is that when I submitted the documents, my joint tenancy expired.Hence do you think they are actually asking for a renewed contract? And is this joint tenancy enough to proceed this application since the joint bank statement I have is from May 2011 (doesn't cover 2 years).

The letter that was received today literally says:
Please provide evidence to show that you and your partner are in a durable relationship. Ideally this should take the form of joint tenancy/mortgage agreements, joint bank statements or joint council tax or utility bills.

It says OR not AND. Would you recommend that I still send the 1 year bank statements and renewed contract?

You will need to provide evidence to cover the two years. A renewed contract would probably not cover time in the past.
