Spouse/ILR dependent

Post by insert12 » Mon Jul 09, 2012 2:33 pm

If any one can case answer below or point me towards guidance note,

if a spouse spend 18 months in uk as tier1 dependent and (Once main appliance of tier1 qualified ILR) then switched her visa to ILR dependent ,

my Questions on above are

1)- "her 18 months stay in UK as tier 1 will add to her ILR dependent visa as to fulfill her 2 years stay in UK requirement before qualifying her ILR ?"

2-) which rules of family migration will implement to her ? As she has qualify her tier1 dependent before 9th of July.

Thanks

Hi Layman,
My wife entered in UK as tier1 dependent visa on 01/10/2011 and by the end 01/10/2013 she will fulfil her 2 year stay requirement to qualify her ILR.

While my ILR is due on 01/06/ 2013 , My questions are if once I obtained my ILR at June 2013

- Do I need to switch my wife visa to ILR dependent which is 'yes' to my understanding, Her time that she has already spend in uk as tier 1 dependent will add to her new ILR dependent visa?

e.g. 19 months as tier 1 dependent and after ILR she will only need to spend 5 more month as ILR dependent to qualify her ILR.

-Which rule will implement to her if she switched to ILR dependent ( Rule before 9th July or after 9th July )

Hope I have clearly states my question.

Since she was in the UK before 9-Jul, the new rules won't apply to her.

I've called Home office today and discuss this issue - They said dependent has to fill FLR(M) form and he/she can apply for ILR after 2 years which is the combination of Tier 1 dependent and FLR(M) time.

No need to wait for 5 years.......
