I am applying for ILR in dec2012 under long residence, and I have 1 dependent wife who will apply using FLR(m). she is already on PBS dependent (Tier 1 PSW) and she has been with me for past 6 years .

Now in which scenario will apply for her ?

Scenario 1
Before 9 July 2012 you were granted entry clearance, leave to enter or leave to remain as the partner of a migrant under the Points Based System, or you have applied for this and are awaiting a decision.

Arrangements applicable
The immigration rules in force before 9 July 2012 will still apply you from 9 July 2012. From October 2013 you will need to pass the Life in the UK test and a B1 level English speaking and listening qualification to qualify for settlement

Scenario 2
On or after 9 July 2012 you apply for entry clearance, leave to enter or leave to remain as the partner of a migrant under the Points Based System.



Arrangements applicable
The new immigration rules apply to your application. A five year probationary period to settlement applies. You will need to pass the Life in the UK test and a B1 level English speaking and listening qualification to qualify for settlement

iam already reading that and there you have told her that she need financial requirement, how ?
1. You are getting mixed up with two posts and the responses accordingly.
2. Old rules will apply but it wud be based on 2 years requirement and not 5 years.
3. Income for settlement will apply as per the guidance.
4. New English language requirements will also apply for settlement.
5. The psot you are referring to is talking about dependents of ilr (10 years) still on Tier 4 visa and have/will be completing 2 years in the UK and if they need to switch to FLR(M) or ILR, that was the issue.
