ILR for child born in India

Post by Niki11 » Tue Jul 10, 2012 12:28 am

Hi,

My husband is eligible to apply for ILR in July 2013. Our child is born in India last October and came to UK this June. My query is, can we apply for ILR for both my husband and our child simultaneously or is there any time frame to wait until we can apply for our child? When can I apply for ILR (I came to UK on dependant visa only in Nov 2010)?. Will the time I spent in India for maternity be included while calculating the period for ILR?

Many thanks in advance for any help provided in this regard.

Your child wont get ILR because he is dependent and will have to wait for 2 years..You can apply for ILR for youself after Nov 2012.

Time period for maternity cover will be considered as absences from United Kingdom for ILR purpose
