Under New Rules- SET(M) or FLR (M) for my wife

I have received my ILR recently.
I was on old style work permit (not point based system)
My wife is with me since December 2006 on firstly student dependent and later on work permit spouse / dependent visa. she have valid visa till May 2013.

My questions are

1- Can she apply directly for ILR under new rules

2- Does 18K Income requirement applicable to her case (not a issue though) (OK now i know correct answer is NO)

3- Does she have to be in UK for Five years or two years to become eligible for ILR. She visited her family on 23 Feb 2008 and returned UK on 22 July 2008. her visa (student dependent) expired on 31st May and she was given entry clearance in July 2008 abroad.
OK now i know correct answer is two years

Thank you in advance for any advice from Mods or Gurus.

Why the SET (M) Guidence on UKBA Website is still older version (SET(M) Guidance Notes version 04/2012)
