Important Query :: Dependents Policy Change

With Effect from 9th July 2012, there has been a changed in the minimum income threshold criteria for the Dependents of the Principal Candidates.

My Query is:

1. Whether this change in minimum income threshold criteria will effect the Dependents of the Tier1 General Migrants as well?

2. Is there any change in the Maintenance Fund criteria that is to be kept for three months?

Hi All,

Which rule will be applied to a Tier1 Dependent having the following scenario?

Initial visa (Entry clearance) granted in Dec 2011.
Lived in UK from Dec 2011 until now.
Current visa expires on Nov 2012.
Going back to India for maternity purposes and will be living in India for a few months probably until March 2013. Planning to return back to UK afterwards.

Will the new rule be applied in this case?
Or will it be still the old rule applicable?

Please advice.

user_name - Which rule are you talking about? The settlement criteria?

If yes then depends on when you are going, before extending your leave or after?

If before, then you will need entry clearance in March 2013 and most probably would fall under the 5 year rule for settlement

If after, then no entry clearance is required and hence should fall in the 2 yr criteria for settlement
